India Imposes Anti-subsidy Duties on Photovoltaic Glass from Vietnam


On May 10, 2025, the Central Board of Indirect Taxes and Customs of the Ministry of Finance of India issued Notification No. 03/2025-Customs (CVD), accepting the final affirmative determination of the Department of Commerce of India on February 11, 2025, regarding the subsidized textured tempered coated and uncoated glass originating from or imported from Vietnam. It was decided to impose a countervailing duty on the subject goods from Vietnam for a period of five years. The duty amount is the difference between the landed value of the imported goods (provided that it is lower than the minimum price) and the minimum price. The minimum price for the Vietnamese producer Flat (Vietnam) Co., Ltd. is 593 US dollars per ton, and for other Vietnamese producers, it is 664 US dollars per ton. Given that India has already imposed anti-dumping duties on the subject goods from Vietnam based on the minimum price, the actual countervailing duty to be imposed in this case is the difference between the countervailing duty determined in this case and the anti-dumping duty actually imposed. The subject goods are tempered glass with a texture, with a transmission rate of at least 90.5%, a thickness of no more than 4.2 millimeters (including a tolerance of 0.2 millimeters), and at least one side dimension greater than 1,500 millimeters, whether coated or not. This product is also known in the market as solar glass, low-iron solar glass, low-iron solar glass, solar photovoltaic glass, high-transmission photovoltaic glass, tempered low-iron embossed solar glass, etc. Textured tempered glass is used as a component for solar photovoltaic panels and solar thermal applications. The transmission level can be achieved by maintaining a low iron content (usually less than 200 ppm). When coated with an anti-reflective coating liquid, the transmission level can be increased by approximately 2% to 3%. This case involves products under Indian customs codes 7003, 7005, 7007, 7016, 7020, and 8541.

 

On February 13, 2024, the Ministry of Commerce and Industry of India issued a notice stating that it had initiated an anti-subsidy investigation into coated or uncoated textured tempered glass originating from or imported from Vietnam at the request of the domestic enterprise Borosil Renewables Limited. The case involves products under Indian customs codes 70071900, as well as certain products under 70031990, 70051010, 70051090, 70052190, 70052990, 70053090, 70071900, 70072190, 70072900, 70169000, 70200090 and 85414011. On February 11, 2025, the Ministry of Commerce and Industry of India made an affirmative final ruling on this case.
